Delaware tax sales

redeemable deed state

Delaware collects delinquent county property taxes through the monition method in Title 9, Chapter 87 of the Delaware Code. The tax collecting authority files a praecipe with the prothonotary, a monition is posted on the property, and a writ commands the county sheriff to expose the real estate to public sale. The property itself is sold, and the sale goes to the Superior Court for approval. The owner may redeem within 60 days after the court approves the sale by paying the purchase price plus 15 percent and the costs of the case.
