Virginia tax sales

deed state

Virginia does not sell tax liens; a city or county sells the delinquent real estate itself through a court case. The locality's tax-collecting officer (usually the treasurer) can start a judicial proceeding once taxes are still delinquent on December 31 following the second anniversary of the date they became due (sooner for some derelict or blighted property). The case runs in the circuit court of the locality, and the property is sold at a judicial sale. The owner can redeem before the date set for the sale by paying into court all taxes, penalties and interest, plus costs including publication and a reasonable attorney fee set by the court.
